To the extent valid, any claim by Customer is subject to arbitration by an arbiter, who will be a practicing attorney in Hidalgo or Cameron County, Texas, depending in which county the claim arose. If the parties cannot agree on an arbiter, a suit will be filed in county court at law in Hidalgo County or Cameron County, Texas (depending on where the claim arose) solely to have this court appoint an arbiter to resolve any claim by Customer.

To the extent valid, damages are limited to the amount of the merchandise purchased by Customer; no special or consequential damages are allowed. No attorney's fees or costs will also be allowed.
